Terms of Service

Parties

These Terms constitute a legally binding agreement between Mohamed Mchaouri, a sole trader established in Germany and trading as DailyNod ("we", "us", "the Service"), and the individual subscribing to DailyNod ("you", "the Customer"). Our full trading name, postal address and contact details are set out in our Impressum / Legal Notice. By completing payment and subscribing, you confirm you have read and accepted these Terms in full.

Subscription & Immediate Provisioning

The Service is offered on two plans, billed monthly on a recurring basis via Stripe: Daily Nod at £8.99 per month, with a check-in every day, and Weekly Nod at £5.99 per month, with a check-in on one chosen day each week. An optional household add-on adds a second participant at the same address for a further £2 per month; both receive the same check-in, and a reply from either counts for both.

By subscribing, you expressly request that we begin providing the Service immediately upon payment confirmation, rather than waiting until the 14-day cancellation period has passed. We start your check-ins straight away on that basis.

Cancellation

You may cancel your subscription at any time via the Stripe Billing Portal or via the link provided in your welcome email. You never need to contact us to cancel, and no further charges are made once you have.

Cancelling ends the check-ins immediately and refunds the unused part of your current billing period automatically - you do not have to ask.

Pausing, Stopping & Billing

Either the participant or the account holder may pause check-ins at any time by replying PAUSE to any message from us, or by choosing a date on the management page. A pause runs for seven days by default and thirty at most, after which check-ins resume by themselves. Replying RESUME restarts them immediately. Pauses may be repeated; where they total more than fourteen days in any thirty-day period, our confirmation message will tell you how long you have paused for and remind you that billing has continued.

Pausing check-ins does not pause billing. Your subscription continues and you are charged as normal for any period in which check-ins are paused. Ending the subscription is a separate action, described under Cancellation above.

A participant may opt out at any time by replying STOP, independently of the account holder. We send one confirmation and no further automated messages to that number.

Service Description & Limitations

DailyNod delivers automated SMS check-in messages to a designated participant and notifies a designated contact if no reply is received within the window you configure. On the Weekly plan the check-in, the reminder and the notification may fall on different days of the same week, so the interval between a missed check-in and a notification can be several days. You choose that schedule and can change it at any time. The Service is delivered on a best-effort basis via Twilio's SMS infrastructure.

We do not guarantee 100% SMS delivery rates, uptime, or alert latency. Network conditions, carrier restrictions, and third-party infrastructure may affect delivery. We accept no liability for failed or delayed deliveries.

Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
